ixvena Terms of Service

Welcome to ixvena.

Please read these Terms of Service (“Terms”) carefully before using our websites, applications, APIs, and related services (collectively, the “Services”). These Terms govern your access to and use of ixvena and form a legally binding agreement between you and us.

Our goal is to support healthier habits and sustainable lifestyle changes while maintaining transparency, fairness, and respect for your rights.


1. Who We Are

2. Acceptance of These Terms

By accessing or using the Services, creating an account, or otherwise indicating your acceptance, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein (collectively, the “ixvena Terms”).

If you do not agree to these Terms, you must not use the Services.

These Terms apply to all users, including visitors, registered users, and subscribers.


3. Eligibility and Age Requirement

You must be at least 18 years old to use the Services.

ixvena is not intended for children or individuals under 18. We do not knowingly allow individuals under 18 to create accounts or provide personal information. If we become aware that an account belongs to an individual under 18, we will take appropriate steps to remove the data and terminate the account.

You are responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.


4. Accounts and Security

To access certain features, you may be required to create an account.

You agree to:

  • provide accurate and complete information
  • keep your account credentials secure
  • maintain only one personal account
  • accept responsibility for all activity under your account

You must notify us immediately of any unauthorized access or security breach. We are not responsible for losses caused by unauthorized use of your account where you failed to safeguard your credentials.

You may delete your account at any time. Account deletion may be permanent and irreversible.


5. Changes to Services and Terms

We may update, modify, suspend, or discontinue any part of the Services at any time, including features, content, pricing, or availability.

We may also update these Terms from time to time. If changes are material, we will provide notice as required by law. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.


6. Content and Intellectual Property

Platform Content

All content made available through the Services, including text, data, designs, software, logos, and algorithms (“ixvena Content”), is owned by Cognitoz I.T Training Sdn. Bhd. or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or commercially exploit ixvena Content without prior written permission.


User-Generated Content

You retain ownership of content you submit to the Services (“User-Generated Content”). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use such content solely for operating, improving, and providing the Services, in accordance with our Privacy Policy.


7. Health, Wellness, and AI Disclaimer (IMPORTANT)

ixvena provides general informational and educational guidance only.

  • ixvena does not provide medical advice
  • ixvena does not provide diagnosis or treatment
  • ixvena is not a substitute for professional medical care

Always consult a qualified healthcare professional before making decisions related to health, diet, exercise, or medical conditions.

Some features may use automated systems, including artificial intelligence or machine learning. These systems may generate suggestions or insights that are incomplete, inaccurate, or biased. You acknowledge that AI-generated outputs are informational only and should not be relied upon as medical or professional advice.

Your use of the Services is at your own risk.


8. Subscriptions and Payments

ixvena may offer paid subscriptions or premium features (“Premium Services”).

Billing and Auto-Renewal

  • Subscriptions may be billed monthly or annually
  • Subscriptions automatically renew unless canceled before the end of the billing period
  • Payment is processed through third-party platforms (e.g., Apple App Store, Google Play)

We do not store your full payment details.


Cancellation

Subscriptions must be managed and canceled through the platform where you originally subscribed (Apple App Store or Google Play). Deleting the app or your account does not automatically cancel a subscription.

Refunds are subject to the policies of the applicable app store and local consumer protection laws.


9. Acceptable Use and Restrictions

You agree not to:

  • scrape, harvest, or extract data from the Services
  • use automated tools without authorization
  • exploit the Services for unauthorized commercial purposes
  • interfere with system security or performance
  • upload malware or harmful code
  • violate applicable laws or third-party rights

We may suspend or terminate access if these rules are violated.


10. Third-Party Services

The Services may link to or integrate with third-party platforms or services. We do not control and are not responsible for third-party content, products, or services. Your use of third-party services is governed by their own terms and policies.


11. No Warranties

The Services are provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law.

We do not guarantee that the Services will be uninterrupted, error-free, or suitable for your specific needs.


12. Limitation of Liability

To the maximum extent permitted by applicable law, Cognitoz I.T Training Sdn. Bhd. shall not be liable for indirect, incidental, consequential, or punitive damages.

Our total liability for any claim arising out of or related to the Services shall not exceed the greater of:

  • USD $500; or
  • the amount you paid us for the Services in the previous 12 months

Nothing in these Terms limits rights that cannot be excluded under applicable consumer protection laws.


13. Indemnification

You agree to indemnify and hold harmless Cognitoz I.T Training Sdn. Bhd. from claims, damages, or expenses arising from:

  • your use of the Services
  • your User-Generated Content
  • your violation of these Terms or applicable law

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to conflict-of-law principles.

If a dispute arises, both parties agree to first attempt to resolve the matter informally and in good faith. Nothing in these Terms restricts your statutory rights under applicable consumer protection laws.


15. International Use

You acknowledge that your data may be processed in countries outside your place of residence in accordance with our Privacy Policy. You are responsible for compliance with local laws where you access the Services.


16. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or applicable law. Upon termination, provisions that by their nature should survive will remain in effect.


17. Miscellaneous

  • These Terms constitute the entire agreement between you and us
  • No partnership, employment, or agency relationship is created
  • Failure to enforce a provision is not a waiver
  • If any provision is found unenforceable, the remainder remains in effect
